These Terms govern your use of Cotiza's mobile and web app and website (the "Service"), operated by Cotiza ("Cotiza", "we", "us"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 18 years old and use Cotiza for your trade or business, primarily in the United States. You're responsible for keeping your account and phone number secure.
2. The Service
Cotiza helps you turn your voice or text into professional bilingual estimates, send invoices, collect payments, and keep job evidence. Features may be added, changed, or removed, especially during the beta.
3. Beta
The Service is offered in beta. It's provided free during the beta, may contain errors, and we don't guarantee uptime, availability, or that any feature will remain free or unchanged. We'll tell you honestly before making a material change to pricing.
4. Fees
- Using the app — creating and sending estimates and managing jobs — is free during the beta. No monthly subscription.
- When a client pays you through Cotiza, the platform keeps a 2% fee on that payment. This applies only when you actually collect through the Service.
- Payment processing fees charged by our processor may also apply and come out on your side, not your client's.
- There is no fee when you simply record a payment you received outside Cotiza (cash, Zelle, check, etc.).
5. Payments and payouts
Payments are processed by Stripe through Stripe Connect. Cotiza facilitates and processes payments on your behalf — the funds for your jobs are yours. You are the merchant of record for your work and are responsible for delivering it. Payouts may be subject to holds, reserves, or review based on risk, and to Stripe's terms. To collect online you must complete Stripe's onboarding and accept Stripe's Connected Account Agreement.
6. AI estimates — you decide
Cotiza's AI suggests line items and prices based on real rates in your area. The AI proposes and you decide — you're responsible for reviewing and approving every estimate and invoice before you send it. You are solely responsible for the accuracy, pricing, and content of what you send to your clients under your name.
7. Disputes and chargebacks
- If a client disputes a card payment with their bank, you can appeal from the app. We compile your evidence (signed work terms, photos, clock-in/out, invoice) and, at your request, submit it to the bank before the deadline. The client's bank — not Cotiza — decides the outcome, and we can't guarantee a result.
- An ACH (bank transfer) return is final and cannot be appealed. Your protection with ACH is the work terms your client signs before you start.
- You're responsible for amounts charged back, refunds you agree to, and related fees. We may recover these from your balance or future payouts.
8. Your responsibilities
- Provide accurate information and use the Service lawfully.
- You are responsible for your own licensing, permits, insurance, taxes, and for the work you perform. Cotiza is a tool — not your employer, contractor, or legal/tax advisor.
- Don't misuse the Service, attempt to defraud clients or the payment system, or upload unlawful content.
9. Intellectual property
The Service, its software, and brand are owned by Cotiza. The content you create (your estimates, invoices, photos) is yours; you grant us the license needed to operate the Service and, during the beta and with your consent, to improve our AI.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind. We don't warrant that estimates or AI prices are accurate for your market or that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Cotiza is not liable for indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim (which, during the free beta, may be zero).
12. Indemnification
You agree to indemnify Cotiza against claims arising from your work, your use of the Service, or your breach of these Terms.
13. Termination
You can stop using the Service anytime. We may suspend or terminate accounts that violate these Terms or present fraud or risk.
14. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Florida.
15. Changes
We may update these Terms. We'll change the "Last updated" date and, for material changes, notify you in the app. Continued use means you accept the updated Terms.
